Terms of Service

BidPacket — a service of ThePMToolkit LLC Effective date: July 28, 2026

These terms are written in plain language on purpose. They're still a binding agreement between you and ThePMToolkit LLC (doing business as BidPacket, "we," "us") when you use bidpacket.co (the "Service"). If you don't agree with them, don't use the Service.

1. What BidPacket is — and isn't

BidPacket takes construction documents you upload (RFPs, plan sets, scopes of work, bid invitations) and generates organized bid preparation materials: project summaries, scope breakdowns, materials checklists, risk flags, questions to confirm, and editable proposal drafts ("Packets").

BidPacket is a bid preparation tool, not an estimating service. This is the most important section of these terms:

• Packets are a first pass, generated by automated analysis of your documents. They may contain errors, omissions, or misreadings — especially with scanned, incomplete, or unusual documents.
• Any dollar amounts in a Proposal Packet are draft estimates only — starting points generated for your market, clearly labeled as drafts. They are not quotes, takeoffs, or bids.
• Items marked "Not specified," "Needs confirmation," or "Verify before bidding" mean exactly that.
• You are solely responsible for verifying all pricing, quantities, measurements, dates, permit and code requirements, and every other detail before you rely on a Packet, send it to a client, or submit a bid. A Packet is never "ready to submit without review."
• BidPacket does not provide professional, legal, engineering, architectural, or estimating advice.

2. Buying a Packet

• Pricing is per Packet, shown before you pay. No subscription, no recurring charges.
• The free preview costs nothing and doesn't require a payment method.
• Payments are processed by Stripe. We never see or store your card number.
• Prices may change, but never for a Packet you've already bought.

3. Refunds

If a Packet isn't right, tell us at [email protected] and we'll refund it — no forms, no argument. We may decline refunds only in cases of clear abuse (for example, repeated purchase-refund cycles on similar documents).

4. Your uploads

• You keep all rights to the documents you upload, and you own the Packets we generate from them.
• You promise you have the right to upload the documents you submit — they're your project's documents, or you're authorized to use them. Don't upload documents you have no rights to, and don't upload anything unlawful.
• You give us a limited license to store and process your uploads solely to provide the Service — generating your preview and Packets. That's the only thing we use them for.
• We do not use your documents or Packets to train AI models, and we don't sell or share them with other customers.
• The documents you upload are retained for 30 days after your order (in case we need them for support or a regeneration), then deleted from our storage. You keep your originals, so nothing is lost.
• The Packets you buy stay available for re-download indefinitely — through your order link, or through a free account. We may retire files for orders refunded or associated with abuse.

5. Accounts

You don't need an account to buy a Packet. If you create one (email sign-in link — no passwords), it simply collects your orders in one place. You're responsible for access to your own email inbox, since that's how sign-in works. You can ask us to delete your account at any time at [email protected].

6. Fair use

Don't abuse the Service: no attempting to breach security, no scraping or reselling the Service itself, no automated mass submissions to the free preview, no uploading malware, and no using the Service for anything illegal. We can refuse or throttle usage that threatens the Service's stability or abuses the free preview.

7. Our stuff

The Service — the site, software, design, and name — belongs to ThePMToolkit LLC. These terms don't give you any rights to it beyond using it as intended. (Your documents and your Packets remain yours, per Section 4.)

8. Disclaimers and limits on liability

• The Service is provided "as is" and "as available." We don't warrant that it will be uninterrupted, error-free, or that any Packet will be accurate, complete, or fit for a particular job.
• To the fullest extent permitted by law, ThePMToolkit LLC's total liability for any claim arising out of or relating to the Service or these terms is limited to the amount you paid us for the Packet giving rise to the claim.
• We are not liable for indirect, incidental, special, or consequential damages — including lost profits, lost bids, cost overruns, or claims by your clients — even if we've been advised such damages are possible. If you submit a bid based on an unverified Packet, that decision and its consequences are yours.
• Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

9. Disputes and governing law

These terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. Before any formal proceeding, contact us at [email protected] — most problems are fixable in one email (see Section 3). Any dispute that can't be resolved informally will be brought in the state or federal courts of Virginia, and you consent to their jurisdiction.

10. Changes

We may update these terms as the Service evolves. The effective date above always reflects the current version, and material changes will be noted on this page. Continuing to use the Service after a change means you accept the updated terms.
